Texas Small Claims Cases
If you are a business owner, you can sue for an unpaid invoice. A lawsuit on an unpaid invoice is an action for recovery of money owed. It’s basically a breach of contract case in which one party owes another money as part of a contractual obligation. A breach of contract case can be filed in Texas small claims courts. Texas law allows for people to form a contract either verbally or in writing. There are some instances where a verbal contract is not binding, however.
The best evidence for a small claims case on an unpaid invoice is (1) verbal testimony, (2) a written purchase order and evidence of delivery of goods/services, (3) a writing or confession that shows the customer didn’t object to the goods/services, and (4) a clear copy of the invoice and terms of payment.
